Generative Artificial Intelligence (AI) Usage Policy

Database Publishing Systems, Inc. (“DPS”) (“we,” “our,” or “us”) is committed to promoting the safe and ethical use of Generative Artificial Intelligence (AI). This Generative Artificial Intelligence (AI) Usage Policy explains your rights and responsibilities for use of the AI-powered tools.
This Generative Artificial Intelligence (AI) Usage Policy applies to our website, and its associated subdomains (collectively, our “Service”) alongside our application, DPS AdTracker® Cloud Platform. By accessing or using our Service, you signify that you have read, understood, and agree to abide by this policy.
About the Platform
Database Publishing Systems, Inc. (“DPS”) is the creator of DPS AdTracker®:Online (ATOL) and the DPS AdTracker® Cloud Platform. DPS created these tools for the direct use of Media Outlets to facilitate advertising production. Media Outlets use DPS AdTracker®:Online (ATOL) and the DPS AdTracker® Cloud Platform to contact advertisers to gather materials, produce creative, display advertising proofs, accept corrections, and ad proof approvals. While DPS AdTracker®:Online (ATOL) does not display unsolicited advertising, it does display advertising that you, the customer, have requested the Media Outlet to create on your behalf.
If you have requested online/digital advertising from the Media Outlet, it may have additional tracking features, added solely at your request, that are not part of the DPS AdTracker®:Online (ATOL) and the DPS AdTracker® Cloud Platform. Please consult your Media Outlet Sales Representative for further information about these features.
If the Media Outlet uses certain tools and services when creating your advertising, those tools and services may have additional Generative AI features. They are not part of the DPS AdTracker®:Online (ATOL) and the DPS AdTracker® Cloud Platform. Please consult your Media Outlet Sales Representative for further information about these features.
Definitions and key terms
- To help explain things as clearly as possible in this Privacy Policy, every time any of these terms are referenced, are strictly defined as:
- Company: when this policy mentions “Company,” “we,” “us,” or “our,” it refers to Database Publishing Systems, Inc., (PO Box 1039, 1080 Elm St. Suite 203, Rocky Hill, CT 06067) that is responsible for your information under this Privacy Policy.
- Country: where Database Publishing Systems, Inc. (“DPS”), or the owners/founders of DPS AdTracker® Cloud Platform are based, in this case is United States of America
- Customer: refers to the company, organization or person that signs up to use the DPS AdTracker® Cloud Platform Service to manage the relationships with your consumers or service users.
- Device: any internet connected device such as a phone, tablet, computer, or any other device that can be used to visit DPS AdTracker® Cloud Platform and use the services.
- IP address: Every device connected to the Internet is assigned a number known as an Internet protocol (IP) address. These numbers are usually assigned in geographic blocks. An IP address can often be used to identify the location from which a device is connecting to the Internet.
- Personnel: refers to those individuals who are employed by Database Publishing Systems, Inc. (“DPS”) or are under contract to perform a service on behalf of one of the parties.
- Personal Data: any information that directly, indirectly, or in connection with other information – including a personal identification number – allows for the identification or identifiability of a natural person.
- Service: refers to the service provided by DPS AdTracker® Cloud Platform as described in the relative terms (if available) and on this platform.
- Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
- Website: DPS AdTracker®:Online (ATOL), DPS AdTracker® Cloud Platform, Database Publishing Systems, Inc. (“DPS”)’s site, which can be accessed via these URLs and any subdomains: https://adservicescloud.com , https://dpsadtrackercloud.com, https://dpsadtrackercloud.co.nz, https://dpsadtracker.com, https://dpsadtracker.zendesk.com, or a customer branded URL.
- You: a person or entity that is registered with DPS AdTracker® Cloud Platform to use the Services.
Prohibited Uses
By using our AI features and those created by your Media Outlet’s third-party integrations You agree not to use our Generative AI features in any manner that:
- Violates any applicable national, federal, state, local, or international law or regulation.
- Exploits, harms, or attempts to harm minors, including depictions of nude minors or minors in a sexual manner.
- Engages in creating or distributing pornographic material or explicit nudity, or content related to sexual abuse or exploitation (except content for scientific, educational, documentary, or artistic purposes).
- Depicts or promotes graphic violence, gore, self-harm, or the promotion of self-harm.
- Generates or disseminates misleading, deceptive, fraudulent, or verifiably false information intended to harm others.
- Facilitates the sale of or provides instructions for creating illegal substances, goods, or services.
- Generates or disseminates personal identifiable information (PII) in violation of privacy or data protection rights.
- Defames, disparages, or harasses others.
- Engages in fully automated decision-making that adversely impacts an individual’s legal rights or creates/modifies enforceable obligations.
- Discriminates against or harms individuals or groups based on personal or protected characteristics.
- Exploits vulnerabilities of specific groups based on age, social, physical, or mental characteristics, in ways likely to cause physical or psychological harm.
- Promotes hatred, harassment, bullying, or insults.
- Promotes terrorism, violent extremism, or threats of violence.
- Provides expertise in sensitive areas, such as medical advice, government services, etc.
- Violates third-party copyright, trademark, privacy, or other intellectual property rights, including generating content that replicates protected assets or copyrighted works.
- Generates content for law enforcement, justice, immigration, or asylum processes, including predicting criminal activity or profiling.
AI-Generated Content
By using our AI features and those created by your Media Outlet’s third-party integrations, you may be asked to submit content, including but not limited to documents, images, or text (“Input”). Based on your Input, our services will generate content such as text, images, or other media (“Output”).
All other terms governing User Content in all of our policies apply to both Input and Output.
Because AI may generate similar outputs for similar inputs, the Output you receive may also be provided to other users. Furthermore, the Output may sometimes be unexpected or unsuitable for some users. Even if it matches that of another user, it is not considered solely your Output.
We reserve the right to limit, disable, suspend, or terminate your access to AI features at any time without prior notice.
Input Guidelines
You may not submit any Input that:
- Includes third-party intellectual property, such as trademarks or copyrighted materials, without sufficient rights.
- Intends to generate Output similar to a third party’s copyrighted work unless you hold sufficient rights.
- Contains personal information unless compliant with all applicable data protection and privacy laws.
- Violates applicable laws or regulations.
- Violates any of our other policies.
We reserve the right to block any Input that violates third-party rights, laws, or any of our policies.
Output Responsibility
You are solely responsible for the creation and use of any Output generated by our AI features. You must ensure that the Output complies with applicable laws and all of our policies.
Due to the nature of machine learning, AI-generated Output may appear credible but can contain false or misleading information (“Hallucination”). We disclaim all warranties, express or implied, regarding the accuracy, reliability, or legality of the Output.
If your Media Outlet is leveraging a third-party AI Integration including, but not limited to, Adobe Firefly, Creatopy, LogRocket, Meta Llama, Microsoft OpenAI, OpenAI ChatGPT, Topaz Labs, Vectorizer.ai, and Zendesk, you are also subject to their AI Policies.
Subject to compliance with this AI Policy, including those of third-party tools used by your Media Outlet, and all other policies, we assign to you our rights to use the Output, including for commercial purposes, unless otherwise specified. Be mindful that if the output violates intellectual property ownership, it is your responsibility to review this. We do not provide you with any protection from intellectual property law violation based upon your user input. Additionally, if your media outlet leverages other AI tools, additional AI usage policies may *SUPERSEDE* or otherwise alter this right and you should be familiar with those:

Additionally, your Media Outlet may impose additional AI Acceptable Usage Policies and rights. You should review your Media Outlet’s primary corporate website for any additional policies.
Accountability and Violations
We reserve the right to take action on your account if any User Content or behavior violates this AI Policy. If you believe someone has violated this policy, please report it by contacting us at legal@creatopy.com.
Changes to this AI Policy
We may periodically update this AI Policy and the Generative AI Additional Terms. If any changes are made, the date of the latest revision will be reflected at the top of this policy.
We encourage you to review this policy periodically. Your continued use of our services following any updates constitutes acceptance of these changes.

By using our AI features, you acknowledge that you have read and understood this AI Policy and agree to be bound by its terms.
